Brisam Retail Private Limited (“Company” or “We”, or “Us” or “Our”) respects your privacy and values the trust you place in it. Set out below is the Company’s privacy policy (“Privacy Policy” / “Policy”) which details the manner in which information relating to you is collected, from when you access or use its website, application and any other online services (hereinafter collectively referred to as “Platform”); used and disclosed. Capitalised words not defined herein can be referred to in the Terms and Conditions.

The User of the Platform (“You”, “Customer”, “User”) are advised to read and understand our Privacy Policy carefully, as by accessing, using the Platform, or registering an account with the Company or browsing the Platform, you expressly agree to be bound by the terms and conditions of this Privacy Policy and unequivocally consent to the collection, storage and use of information relating to you as provided herein. If You provide us with Personal Information about someone else, You confirm that they are aware that You have provided their information and that they consent to our use of their information according to our Privacy Policy. You may opt-out at any time to prevent further use of the information shared via the Platform. For the purposes of this Policy, “Personal Data” or “Personal Information” means any and all indicators and identifiers that enables to identify a natural p erson directly or indirectly with reference or regard to identifiers such as a name identification number, location data, online identifier, characteristic, trait, attribute or any factor specific to that person’s physical, physiological, genetic, mental, economic, cultural or social identity.

Our Privacy Policy is incorporated into the Terms and Conditions of the Platform and is subject to change from time to time without notice. This Privacy Policy is published in accordance with the provisions of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data of Information) Rules, 2011 under the Information Technology Act, 2000 and other Applicable Laws that provide rules, regulations and guidelines on access, collection, usage, disclosure, transfer or otherwise processing of Personal Information and sensitive Personal Information.

1. DEFINITIONS:

1.1 “Applicable Law(s)” shall mean and include all applicable statutes, enactments, acts of legislature or parliament, laws, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives and orders of any governmental authority, tribunal, or a court of India;

1.2 “Application” means the mobile application, ‘DealShare’;

1.3 “Company”, “Us”/, “Our”, “We” means Brisam Retail Private Limited;

1.4 “Cookies” means certain small amount of data or information/identifiers that is placed automatically on the User’s hard drive when they access the Platform;

1.5 “Personal Data” or “Personal Information” means any and all indicators and identifiers that enables to identify a natural person directly or indirectly with reference or regard to identifiers such as a name, identification number, location data, phone number, address, password, financial information such as bank account or credit card or debit card or other payment instrument details;

1.6 “Platform” means the Application, Website, or any other online platform operated by the Company, as applicable, wherein the User will be able to purchase the goods and services offered and interact with the Company;

1.7 “Services” means provisioning of certain services offered by the Company through the Platform to the User, and includes any related services in relation to the same;

1.8 “Terms and Conditions” Conditions” means Terms and Conditions of the Company as updated from time to time and available on Terms and conditions;

1.9 “Website” means the website, www.dealshare.in;

1.10 “You”/ “you”, “Your”/”your”, “User” “User” means any user of the Platform.

2. APPLICABILITY

2.1 This Policy applies only to such information the Company collects through your usage of the Platform, and/or via email, text and other electronic communications sent and received through or in connection with the Services.

2.2 This Policy does not apply to the information that you provide to, or that is collected by, any third-party, that you use in connection with the Platform and/or the Services. You shall be bound by the privacy practices adopted by such third parties. The Company shall not be liable or responsible for any such actions of any third parties. You must consult directly with such third parties about their privacy practices.

2.3 Some information, including, but not limited to, usage information and other information that may arise from your interaction on the Platform, cannot be used to identify you, whether in combination with other information or otherwise and will not constitute Personal Information for the purposes of this Privacy Policy

3. COLLECTION OF INFORMATION

3.1 We may collect the information either directly, as provided by you or automatically track and collect certain information about you as you navigate on the Platform.

3.2 When you install or use the Platform, We will collect Personal Information from you and any devices you may use in your interaction with the Platform. The information collected automatically may include but not limited to the your use of the Platform, irrespective of registering or logging in, devise usage details, geo-location, your IP address, device ID or unique identifier, device manufacturer and type, device and hardware settings, SIM card usage, applications installed on your device, ID for advertising, ad data, operating system, web browser, operator, IMSI, connection information, screen resolution, usage statistics, default communication applications, access to device address book and messages, device log and event information, logs, keywords and meta data of incoming and outgoing calls and messages, version of the Platform you use and other information based on your interaction with the Platform such as how the Services are being accessed (via another service, website or a search engine); the pages you visit and features you use on the Platform, content viewed by you, content you have commented on or sent to us and information about the ads You see and/or engage with, the search terms you use, order information and other usage activity and data logged by Company’s servers from time to time. We may collect information through cookies, web beacons and other tracking technologies.

3.3 We will collect your Personal Information which is provided by you from time to time through the Platform, including but not limited to your full name, phone number, e-mail id, password created on the Platform, age, residential address, date of birth, gender, location, device information, your profile picture, if any, the search terms and results, your browsing information, your communications, interactions, participation on the Platform in any survey, poll, contest or promotion, your transactional information, including the payment methods and other details. We may also collect such information that you provide relating to your preferences and settings in the Platform and any reviews that you may post in relation to the Services and the usage of the Platform.Services and the usage of the Platform.

3.4 The Company does not knowingly solicit or collect Personal Information from children under the age of 18. Use of the Platform is available only for persons capable of forming a legally binding contract under the Indian Contract Act, 1872. If you are providing any information of a minor under the age of 18, you represent that you are legally authorized to do so.

3.5 We may contact you for verification purposes or with information pertaining to the Services, OTP generation, payment or special offers, e.g. newsletter e-mails, SMS and similar notifications about Our Services. We also use the collected information to respond to you when you contact Us.

3.6 If you choose to provide feedback on the Platform, or such other medium, post messages on our message boards, chat rooms or other areas, We will collect that information you provide to Us. We retain this information as necessary to resolve disputes, provide customer support and troubleshoot problems as permitted by Applicable Law.

3.7 If You send us or our agents, representatives or partners personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the Platform, We may collect such information into a file specific to You.

3.8 The Company shall in no manner be responsible for the accuracy of the personal or other information shared by you to the Company or to any third party. If you provide any information that is false, inaccurate, non-current or incomplete (or is erroneous, wrong, non-current or incomplete), or whether the Company has fair grounds to believe whether such details is false, wrong, non-current or incomplete, the Company shall reserve the right to suspend or terminate your account at its sole and absolute discretion.

4. CONSENT AND USE OF THE INFORMATION

4.1 By visiting the Platform, utilizing the Services and providing your information, you consent to the collection, use, disclosure and otherwise processing of your information in accordance with this Privacy Policy. If you disclose any Personal Information relating to any other people to Us, you represent that you have the authority to do so and to permit Us to use the information in accordance with this Privacy Policy.

4.2 You authorize and expressly consent Us to share your Personal Information with third parties including but not limited to the Our agents, service providers, as and when necessary.

4.3 While providing Your Personal Information on the Platform, you expressly consent to the Company (including its other corporate entities, group companies, technology partners and other third party entities, marketing channels and business partners) to contact you through SMS, push notifications, instant messaging apps, including but not limited to WhatsApp, call and/or e-mail.

4.4 You have the right to withdraw your consent that you have already provided in accordance with the terms of this Privacy Policy and the Terms and Conditions, but please note that withdrawal of consent will not be retroactive. In the event that you withdraw consent given to Us under this Privacy Policy, We reserve the right to restrict or deny the provision of Our Services for which We consider such information to be necessary.

(i) sending you in application push notifications and reminders and delivering messages with respect to the Services;

(j) to comply with Applicable Laws, rules and regulations;

(k) sharing with you the updates, information on any new or existing products/service improvements along with their terms and conditions;

(l) providing you with information or updates relating to promotions on related, affiliated or associated service providers and partners, that we believe would be of interest to you;

(m) measuring consumer interest in our products and Services; and communicate to you about online and offline offers;

(n) facilitating promotion, marketing, web analytics, and advertising activities, to the extent We use your personal information to market our products and Services to you, We will provide you the ability to opt-out of such uses;

(s) conducting online surveys, quizzes and poll.

4.6 Your Personal Information is stored only for as long as needed to fulfil the above aims and such time period as per our internal policy and Applicable Laws.

5. SHARING AND DISCLOSURE OF THE INFORMATION

5.1 We may share or disclose your Personal Information with our other corporate entities, affiliates, group companies, contractors, advertisers, service providers, technology partners, merchants and other third parties. This disclosure may be required for Us to provide you access to the Platform and/or the Services, fulfilment of your orders, support our business (logistics, delivery, communication and payments), for enhancing your experience, to comply with our legal obligations, to protect and defend our rights and enforce Our agreement(s), to facilitate Our marketing and advertising activities, to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to Our Services. We may disclose Personal Information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to enforce and/or to investigate and address violations of our Terms and Conditions or Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of any third party; or protect the rights, property or personal safety of Our customers, employees or the general public. We may verify the user profile information provided by you with third party providers and ensure technical service functionality and data accuracy, perform trouble-shooting and prevent or detect fraud, security breaches or illegal activities.

5.3 We may share/sell some or all your Personal Information with another business entity/buyer or a successor should We plan to merge with, or be acquired by that business entity, or re-organization, amalgamation, restructuring of business, in whole or in part. Should such a transaction occur, the other business entity (or the new combined entity) will be required to follow this Privacy Policy with respect to your personal information.

6.1 The Platform may link to other the websites or applications of third parties who may collect Personal Information about you; you may be directed to other websites or applications that are operated and controlled by third parties that we do not control. The Company is not responsible for the privacy practices or the content of those linked websites or applications of the third parties and you are requested to carefully read the other websites or in-apps privacy policy when visiting such websites.

6.2 If you interact with any social media features and/or instant messaging applications on our Platform; or use your social media credentials to log-in or post content, these features may collect, process or share information about you and your use of the Platform; they may post information about your activities on the respective social media and/or instant messaging applications. Your interactions with these social media companies and/or instant messaging applications are governed by their privacy policies; the Company shall in no event be responsible or liable for the same.

6.3 This Privacy Policy does not cover the information you choose to provide to or that is collected by any third parties as mentioned above. We recommend you to reach out to such parties and read their respective privacy policies.

7. CONTESTS AND PROMOTIONS

7.1 We may offer certain promotions and/or arrange for contests through the Platform/ Services that may require your Personal Information and such other details, including registration for such contests and promotions. By participating in such promotions or contests, you are agreeing to the official rules issued by the Company that govern those promotions or contests; specific information relating to you, including, allowing the Company and/or any third party/sponsor of the promotions or contest to use your name and/or such other information as provided by you. Such third parties/sponsors may also use your information in advertising or marketing associated with the promotions and/or the contests. If you choose to enter a promotion or contest, you agree that your information may be disclosed to such third parties/sponsors or the public in connection with the administration of such promotions and/or the contests, including, in connection with winner selection, award/prize fulfilment, and as required by Applicable Law or permitted by the promotions’/contest’s official rules.

8. DATA RETENTION

8.1 We retain your Personal Information in accordance with Applicable Laws, for a period no longer than is required for the purposes for which it was collected or as required under any Applicable Law. However, we may archive or retain data related to you if we believe it may be necessary to investigate, prevent fraud or future abuse, in connection with the Services or if required by Applicable Law, or for other legitimate purposes. We may continue to retain your data in anonymised form for analytical and research purposes.

8.2 In order for Us to close the account you created, you need to either close the account by visiting the settings page on the Platform or by sending us a request via email stating the reasons for closure of the account. Thereafter, after certain period of time, we will either delete your information or de-identify it so that it is anonymous and aggregated, and not attributed to your identity, then may be held by Us as long as necessary for Us to provide our Services effectively and the process mentioned in clause 8.1 above will be followed. Our use of the anonymized and aggregated data will be solely for analytic purposes.

9. SECURITY PRECAUTIONS

9.1 We adopt reasonable security practices and procedures to protect from unauthorised access, breach, damage, unauthorised use, modification, disclosure or impairment of the information under our control. We use a secure server to provide Services and aim to ensure maintenance of reasonable physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access to your information and to maintain data security. We adhere to current/upgraded technology and generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. The Company servers are accessible only to authorized personnel and information received or stored is shared with such authorized personnel on a need-to-know basis and to provide the Services requested by you.

9.2 In using the Platform, you understand and acknowledge the inherent security implications of data transmission over the internet and the World Wide Web cannot always be guaranteed as completely secure. You are responsible for ensuring the protection of login and password records for your account. You are also responsible for all uses of your account and password, whether authorized by you or not. You shall inform Us promptly of any true or alleged improper use of your account or password.

9.3 We assume no liability or responsibility for disclosure of your information due to errors in transmission, unauthorized third-party access, or other causes beyond our control. If We receive any communications or instructions using your username and password, We will consider that you have authorized the instructions for such use..

9.4 Please note that the Company will not ask you to share any sensitive data or information via email or telephone. If you receive any such request by email or telephone, please do not respond/divulge any sensitive data or information and forward the information relating to the same to grievance.redressal@dealshare.in for necessary action.

10. CHOICE TO OPT-OUT

10.1 We provide you the option of not divulging any specific information that you wish for us not to collect, store or use. You understand that there may be certain restrictions or limitations in our provision of Services or your use of Our Platform if certain information sought is not provided to us by You.

10.2 You may also choose not to use a particular service or feature on the Platform and opt-out of receiving any non-essential (promotional, marketing-related) communications from Us and on behalf of Our partners, after setting up an account. If You want to remove your contact information from all the Company lists and newsletters, please choose the ‘unsubscribe’ or equivalent option provided in the mailers that you receive from Us.

10.3 Once You choose to opt-out, We will handle Your data as per the process detailed in clause 8.2 above.

11. CHANGES TO THE PRIVACY POLICY

11.1 We reserve the right to amend this Privacy Policy and may at any time without a separate notice or liability, change/amend this Privacy Policy. You also agree and acknowledge that the Company has no liability whatsoever in relation to this Privacy Policy and You shall not initiate any legal proceedings against the Company and any person related thereto with respect to the Policy.
